EU Data Act Information
In the EU, Regulation (EU) 2023/2854 (“Data Act”) provides data access rights to users of connected products and related services. Please see below information regarding the product data and related service data that may be generated by products and services of SZ Avinox Innovation Co., Ltd. and its affiliated companies (“Avinox”).
Product Data
Avinox manufactures powerful, compact e-bike drive systems which are deployed by leading bicycle brands around the world, enabling riders to tackle complex rides with ease.
When such products qualify as ‘connected products’ under the Data Act, they may generate varying types and volumes of data depending on the type of device, its functionalities, software version, user settings and how the user uses it (e.g., device logs). Such data will be provided as “.txt” or “.csv” files.
The products can generate such data continuously while in use, and in real-time. By default, the data is stored on the device. It is retained until the user deletes it from the device, or until it is automatically overwritten by newer data when on-device storage is full. To the extent users choose to provide their data to Avinox, it is retained in accordance with Avinox’s applicable retention policies, unless user deletes the data first.
Related Service Data
Avinox offers related services including mobile app (e.g., Avinox Ride) to support users when operating and managing its products.
When such services qualify as ‘related services’ under the Data Act, they may generate varying types and volumes of data, depending on the type of service, its functionalities, software version, user settings and how the user uses them (e.g., app logs, product improvement data). Such data is stored on-device and Avinox servers (if users choose to upload it or when users choose to participate in the app’s product improvement project) in the same manner and for the same duration as product data. The data will be provided as “.txt” or “.db” files.
· How to Access Data
Users can contact Avinox at support@avinox-ebike.com to submit a request to access, retrieve and erase such data subject to Avinox’s Data Act Terms available at: https://www.avinox-ebike.com/terms/eu-data-act. Users may also grant or revoke third parties’ access to such data, for purposes specified by the user, via this email channel. Please note that data access may be subject to restrictions to safeguard trade secrets. Where we are the holder of such trade secrets, we will take appropriate measures to protect their confidentiality. If we are not the trade secret holder, we will take steps to inform the user of their identity.
Avinox may use the non-personal product and related service data, and share it with third parties for lawful commercial and non-commercial purposes, including but not limited to, performing its agreements with users and any activities related thereto; operating its business; providing and improving its products and services and developing new products and services; enabling research and innovation; supporting marketing initiatives; detecting and preventing possible fraud or misuse; maintaining system security; enabling mergers, acquisitions, or sale of business or assets; enforcing applicable terms and conditions; establishing, exercising and defending legal rights and complying with applicable law, industry standards and Avinox policies. Our Privacy Policy specifies how we process data that qualifies as ‘personal data’.
